Thailand Visa Information

Citizens from over fifty countries can enter Thailand without charge for thirty days without having a visa. A few of these countries include the United States, Australia, New Zealand and more. Your passport must be valid for six months past your planned departure.

Thailand Tourist Visa
Tourist visas are good for sixty days and you can get one through a Thai Embassy or the consulate in your country. You can get a visa through the mail and the cost is $25. Once the visa is issued it must be used within 90 days from the date it was issued. The visa is invalid when leaving Thailand, even if the traveler hasn’t stayed in Thailand for sixty days. There are other types of visas available but generally they don’t apply in the case of visiting Thailand on holiday.

Thailand Work Visa
Your first step to obtaining a work visa is getting a non-immigrant visa to apply for a work permit. Any foreigner that receives a work permit must follow the permit regulations.

1. Carry the work permits with them or keep it in the office during work hours at all times to show government officers at any time. Violators can be fined up to 1,000 baht.

2. Foreigners must perform work according to the permit only. If the worker wants to change their work permission must be granted prior. Violators can be imprisoned for up to 1 month or fined up to 2,000 baht or both.

3. Foreigners wanting to continue work must apply for an extension prior to their work permit expiration date. Violators can be imprisoned up to 3 months and/or fined up to 5,000 baht.

Overstaying your Visa
Overstaying your visa is a serious matter that should be taken very seriously. You can clear up an overstay when you leave Thailand by paying any fines at the airport. In some cases overstaying your visa may make you subject to arrest. If you are stopped by the police for any reason and they find out you have overstayed your visa, they can and will arrest you. Being arrested in Thailand for overstaying your visa is fairly common but it is also a very unpleasant experience. The Immigration Detention Centers are known for being uncomfortable and dangerous! In extreme cases it is possible to be blacklisted from ever visiting Thailand again in addition to any fines and detentions you may receive. Always make sure you are visiting Thailand legally and you will have nothing to worry about.

The Pattaya Beach

Pattaya is one of the most popular and beautiful destinations within Thailand. Pattaya is located on the eastern coast of the Gulf of Thailand. Thailand is a country that basically does not permit foreigners to buy land. However, it is possible for a foreigner to buy apartments and condominiums in Thailand. This is on the condition that foreigners don’t own more than 49% of the number of units in a single building. It is possible for a foreigner to sell the condo when required, and deposit the money into an overseas account without any hassles.

Foreigners can invest in property in Thailand if their spouse is a Thai. However, the property has to be in the spouse’s name, and it has to be declared that the money spent for the property is the spouse’s. However, in the eventuality of the spouse dying, the foreigner cannot claim the rights to the property.

However, this is not the case when a foreigner invests in a condo. Here, when the Thai spouse passes away, it is possible to legally transfer the property to the foreigner. How to buy land as a foreigner

Thailand is a country that does not basically permit a foreigner to buy any land in Thailand. However, there are some means and alternatives a foreigner can resort to if one plans to buy land in Thailand.

One of the means for a foreigner to buy land in Thailand is to buy the land in the name of a Thai company. This means that the company should be a company where about 51% of the shares of the company are Thai, and 49%, foreign. Foreigners having some investment in Thailand are also permitted to buy land in Thailand. They have to have invested at least 40 million Baht for not less than 5 years for investments other than ownership or real estate. With this investment, the foreigner can buy a maximum of one rai (1,600 square meters) of land for residential purposes. However, it is better to get some permission from the Ministry of Interiors before buying the land.

The Thai property law was amended in 1999 where Thais having foreign spouses can legally own land in Thailand. However, the property has to be registered under the name of the Thai, and the foreigner has to sign a declaration declaring that the funds of the real estate investment come from the Thai spouse. With this, the foreigner is waived right of ownership over the land.

Another option foreigners have for acquiring land in Thailand is leasing. The Thai property law permits a maximum leasing of 30 years, with renewal if agreed upon by the leaser and lessee. This proves to be the best means for a foreigner to acquire land as it is the least complicated. However, land leases of more than 3 years have to be registered at the Land Department.

Foreigners can also opt for structural ownership where their company or Thai spouse can allot a Right of Superficies which lies in favor of the foreigner. With this, the foreigner can own all the constructions that are found on the land. With this, the foreigner is registered as the owner of the house, but not the land. This Right of Superficies stays in force for 30 years, and can be renewed for another 30 years. However, this is not done automatically.

Whatever the means one adopts to buy land, it is better to conduct a title search as there are various levels of title deeds. Verify with the Land Department on the type of deed the land has, and its legality. With this, you will learn more about the land and its obligations.
